Did you know that Rules 101.8
and 101.10 prohibit against Sexual Harassment and work place harassment?
Rule 101.8
establishes that:
- Every staff
member has the right to work in an environment which is free of sexual
harassment, and to not be sexually harassed by any others in the
workplace. The General Secretariat will take appropriate steps to
promote such a working environment, and it will not tolerate behavior
which is not respectful of that right.
- No staff
member shall sexually harass another staff member or any other person
who comes onto the General Secretariat's premises. Every staff member
has the right to object and to file a complaint should sexual harassment
occur and to expect the Secretary General to deal seriously and promptly
with that complaint; and every staff member may be subject to such a
complaint filed by any other person in the workplace.
- All
supervisors and other staff members are obligated to comply with the
General Secretariat's policy against sexual harassment and shall take
appropriate measures to ensure that sexual harassment does not occur.
Staff members who violate that policy will be subject to disciplinary
action.
- The
Secretary General shall issue the Administrative Provisions (among them Executive Order 95-7)
to implement and enforce this Rule and assure that the policy on the
prohibition against sexual harassment and the corresponding sanctions
for non-compliance shall extend to independent contractors and interns,
which may include, among others, termination for cause.
Rule 101.10 established also that:
- No staff member, irrespective of position or grade
shall commit Workplace Harassment. All staff members shall strive
to treat each other, as well as independent contractors, interns and
other persons providing services to the General Secretariat, with
respect and dignity in the workplace. The General Secretariat
shall not tolerate workplace harassment by staff members and any other
persons providing services to it in the workplace.
The above
mentioned rule also details what constitute harassment, and specify that
the General Secretariat will act, with due seriousness and promptness,
on claims of harassment following the relevant Guidelines and Procedures for
the Prevention and Treatment of Workplace Harassment established in the Executive Order
No. 05-7 Rev. 1 and that also prohibits any staff to threaten or
retaliate against an individual who alleges in good faith have been the
victim of harassment.
Furthermore, the
Staff Committee participates in the newly created "Task Force"
headed by the Secretary of Administration and Finance with the purpose of
reviewing the policies and regulations of the Organization regarding the
identification and investigation of cases of workplace and sexual harassment.
Thanks to the
commitment expressed by the Secretary General it is expected that the General
Secretariat will start in the coming months a training for all staff,
consultants, interns, volunteers and service providers on this issue, as well
as the rules and procedures.

que las Reglas 101.8 y 101.10 prohíben, respectivamente, el acoso sexual y
laboral?
La regla 101.8 establece que:
- Todo
funcionario tiene derecho a trabajar en un entorno libre de acoso sexual
y a no ser objeto de acoso sexual por parte de ningún otro funcionario
en el lugar de trabajo. La Secretaría General adoptará las medidas
pertinentes para fomentar este ambiente de trabajo y no tolerará un
comportamiento que no sea respetuoso de ese derecho.
- Ningún
funcionario acosará sexualmente a otro funcionario ni a ninguna otra
persona que se encuentre en las instalaciones de la Secretaría General.
Todo funcionario tiene derecho a objetar y presentar un recurso si
ocurriese acoso sexual y a esperar que el Secretario General considere
con seriedad y prontitud dicho recurso. Todo funcionario puede ser
objeto de este recurso que presente cualquier otra persona en el lugar
de trabajo.
- Todos
los supervisores y demás funcionarios cumplirán con la política de la
Secretaría General contra el acoso sexual y adoptarán las medidas
adecuadas para asegurar que no ocurra. Los funcionarios que violen esta
política estarán sujetos a medidas disciplinarias.
- El
Secretario General publicará disposiciones administrativas (entre ellas
la Orden Ejecutiva N.º 95-7, “Prohibición del acoso
sexual”) para implementar y hacer cumplir esta
regla y asegurar que la política sobre la prohibición del acoso sexual y
las sanciones correspondientes por incumplimiento sean aplicables a los
contratistas independientes y a los pasantes, las cuales pueden incluir,
entre otras cosas, la rescisión de contrato.
La regla 101.10 establece,
principalmente, que:

Ningún funcionario, independientemente de su cargo o
grado deberá cometer acoso laboral. Todos los funcionarios deberán procurar
para con los demás, incluidos los contratistas independientes, pasantes y
cualquier otra persona que preste servicios a la Secretaría General, un trato
respetuoso y digno en el lugar de trabajo. La Secretaría General no tolerará
el acoso laboral por parte de ningún funcionario o cualquier otra persona que
preste servicios en el lugar de trabajo.

La citada regla también detalla lo que incluye acoso laboral,
determina que la Secretaría General atienda, con la debida seriedad y
prontitud, los reclamos por acoso laboral conforme a las correspondientes
Pautas y Procedimientos para la Prevención y Tratamiento del Acoso Laboral
previstos en la Orden Ejecutiva N.º 05-7, rev. 1; y
prohíbe que cualquier funcionario amenace con tomar o tome represalias contra
un individuo que alegue de buena fe haber sido víctima de acoso laboral.
Asimismo,
el Comité del Personal participa en el recientemente creado “Task Force”
liderado por la Secretaria de Administración y Finanzas para realizar una
revisión de las políticas y normativas de la Organización respecto a la
identificación e investigación de casos de acoso laboral y sexual.
Gracias
al compromiso expresado por el Secretario General se espera que en los
próximos meses se de inicio a capacitaciones para todo el personal,
funcionarios, consultores, pasantes, voluntarios y proveedores de servicios,
sobre este tema, sus normas y procedimientos.
