Did you know that Rule 102.3
of the Staff Rules is a tool to guarantee equal remuneration? Equal pay for equal work is a principle
of labor rights recognized and guaranteed in the national constitutions of many
member countries of the OAS. In many cases, this guarantee stems from
the implementation of Convention 100 of the International Labour
Organization, according to which work that requires comparable
abilities, training, effort and responsibility and are carried out under
similar work conditions, should be paid equally. Convention 100 principally seeks to
address discriminatory situations relating to the equal remuneration between
men and women for comparable work. Nevertheless, this situation applies
equally and is a right that pertains to all civil servants (national and
international) and responds to corresponding remuneration for the responsibilities
being carried out. In the framework of the OAS, the
Administrative Tribunal addressed this issue in its Judgements 157, 158, 159,
160 and 161. Taking into consideration these legal precedents, the OAS
Staff Rule 102.3(e) establishes that “[…] The classification of the
posts in each Secretariat, Department or Office of the General Secretariat
will be reviewed periodically by the Department of Human Resources.
This Department will review these posts a) at its own initiative, b) by
petition from the respective incumbent, or c) at the request of their
supervisors.” In this manner, the Organization
guarantees addressing the rights of all staff ensuring that they are not
subject to discriminatory treatment without legal justification or an
arbitrary application of norms. For more information, visit Staff

que la Regla 102.3 del Reglamento del Personal es una herramienta que
garantiza la igualdad de remuneración? El principio de igual remuneración por igual trabajo es un
principio del derecho laboral reconocido y garantizado en las constituciones
nacionales de muchos países miembros de la OEA. En muchos casos esta garantía
deriva de la implementación el Convenio 100 de la Organización
Internacional del Trabajo, según la cual los
trabajos que requieran igual habilidad o capacitación, esfuerzo y
responsabilidad y son desempeñados bajo similares condiciones de trabajo,
deben ser pagados igual. El Convenio 100 buscaba, principalmente, atender situaciones discriminatorias
relativas al principio de igualdad de remuneración entre la mano de obra
masculina y la mano de obra femenina por un trabajo de igual valor. No
obstante, esta situación se aplica de igual manera y es un derecho que
les asiste a los funcionarios públicos (nacionales e internacionales) a
percibir la retribución correspondiente al cargo que efectivamente
desempeñan. En el marco de la OEA, el Tribunal Administrativo consideró este tema
también en las sentencias 157, 158, 159, 160 y 161. En atención a estos
antecedentes legales, el Reglamento de Personal de la OEA establece en la
Regla 102.3 (e) que […]. La clasificación de los cargos en cada Secretaría,
Departamento u Oficina de la Secretaría General será revisada periódicamente
por el Departamento de Recursos Humanos. Dicho Departamento podrá revisar los
cargos: a)- por iniciativa propia, b)- por petición de los titulares
respectivos, o c)- por petición de sus supervisores […]. De esta manera la Organización garantiza atender a los derechos de todos
los funcionarios asegurando que no se dispense un tratamiento
discriminatorio, sin justificación legal o por aplicación arbitraria de la
